1. Introduction

Welcome to One Island.

These Terms of Use ("Terms") govern your access to and use of the One Island website, mobile applications and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Services.

These Terms are designed to help ensure that One Island remains a safe, reliable and trusted platform for everyone. They explain the rights and responsibilities of both you and One Island when using the Services, including how certain features operate, the standards we expect from users and the limitations that apply to our Services.

These Terms should be read alongside our Privacy Policy, Cookie & Similar Technologies Policy and any additional terms or guidelines that may apply to specific features or Services made available through One Island.

2. About One Island

One Island is operated by One Island Limited (Company Number: 139189C), an Isle of Man company ("One Island", "we", "our" or "us").

One Island is a technology platform designed to bring together trusted local information, services and communities in one place. Through our website, mobile applications and related Services, we enable users to discover, access and interact with a wide range of information and features, which may include:

  • local news and public notices;
  • transport information, including bus, ferry and flight services;
  • journey planning and travel information;
  • taxi booking services;
  • events and community activities;
  • business listings and local promotions; and
  • other current or future Services made available through the One Island platform.

One Island provides the technology that enables access to these Services. Unless we expressly state otherwise, we do not own, operate or control the third-party organisations, businesses, transport providers, event organisers, taxi operators or other service providers whose information or services may be made available through the platform.

Those organisations remain responsible for the information they provide and the services they deliver. Your use of those services may also be subject to separate terms, conditions and privacy policies provided by the relevant organisation.

As One Island continues to evolve, we may introduce new features, remove existing features or modify how Services operate. These Terms apply to all current and future Services unless we notify you otherwise.

3. Acceptance of these Terms

By accessing or using the One Island Services, you confirm that you have read, understood and agree to be bound by these Terms of Use.

If you do not agree with these Terms, you must not access or use the One Island Services.

These Terms should be read alongside our Privacy Policy and Cookie & Similar Technologies Policy, which explain how we collect, use, store and protect your personal information, and how we use cookies and similar technologies. Where additional terms, conditions or guidelines apply to specific Services or features, we will make those available to you at the relevant time.

If you are using the One Island Services on behalf of a business, organisation or another legal entity, you confirm that you have the authority to accept these Terms on their behalf. In that case, references to "you" in these Terms include both you and the organisation you represent.

4. Eligibility

4.1 Age Requirements

The One Island Services are intended for use by individuals who meet the minimum age requirements applicable to the Services they wish to access.

Some Services may have specific age requirements, eligibility criteria or require the involvement or consent of a parent or legal guardian. Where this applies, the relevant requirements will be explained within the relevant Service or in separate terms and conditions applicable to that Service.

For example, Taxi Services are subject to separate Taxi Customer Terms, which include additional eligibility requirements.

By using the One Island Services, you confirm that you meet any applicable age requirements.

4.2 Personal Accounts

Where an account is required, you must provide accurate, complete and up-to-date information.

You are responsible for ensuring that the information associated with your account remains accurate and for updating it where necessary.

You must not:

  • create an account using false or misleading information;
  • impersonate another person or organisation;
  • create multiple accounts for fraudulent or abusive purposes; or
  • allow another person to use your account in a way that breaches these Terms.

4.3 Business Accounts

Certain One Island Services may be available to businesses, organisations, event organisers, taxi operators, community groups or other commercial or non-commercial entities.

If you create or manage a business account, submit business information, publish events, manage listings or otherwise act on behalf of an organisation, you confirm that you have the authority to do so.

You are responsible for ensuring that any information submitted on behalf of an organisation is accurate, lawful and kept up to date.

We reserve the right to verify the ownership or authority of business accounts and may suspend or remove access where we reasonably believe that an account has been created or used without appropriate authority.

5. Your Account

Some features of the One Island Services may require you to create an account. Creating an account allows you to access additional features, personalise your experience and use Services that require user identification.

You are responsible for ensuring that the information associated with your account is accurate, complete and kept up to date at all times.

You are also responsible for maintaining the confidentiality of your login credentials, including your password, and for all activities carried out using your account. You must:

  • provide accurate and truthful information when creating or updating your account;
  • keep your contact details up to date;
  • choose a strong password and keep it secure;
  • notify us promptly if you believe your account has been accessed or used without your permission; and
  • take reasonable steps to prevent unauthorised access to your account.

You must not:

  • share your account credentials with another person;
  • use another person's account without their permission;
  • create accounts using false or misleading information;
  • attempt to bypass authentication or security measures; or
  • create or use accounts for fraudulent, abusive or unlawful purposes.

You may close your account at any time using the functionality provided within the One Island Services or by contacting us. Closing your account may result in the loss of access to certain features, preferences and account history.

Account deletion and the handling of your personal information will be carried out in accordance with our Privacy Policy. We may retain certain information where we are required or permitted to do so by law, or where it is necessary to protect our legitimate interests, including fraud prevention, security, dispute resolution and regulatory compliance.

6. The One Island Services

One Island provides a technology platform that brings together a range of information, services and features designed to help residents, visitors, businesses and communities discover, access and interact with the Isle of Man.

Depending on the Services available at the time, One Island may provide access to:

  • local news, community information and public notices;
  • transport information, including bus, ferry and flight services;
  • journey planning, travel information and related transport features;
  • taxi booking services and other mobility-related features;
  • local events, activities and community listings;
  • business directories, business information and local promotions;
  • location-based information and points of interest; and
  • other information, tools and digital services that support life on the Isle of Man.

Some Services are provided directly by One Island, while others rely on information, content or services supplied by independent third parties, including government organisations, transport providers, businesses, event organisers, taxi operators and other partners.

Unless we expressly state otherwise, One Island provides the technology platform that enables you to discover, access and interact with these Services. We do not own, operate or control every organisation, service or item of information made available through the platform.

The availability, content and functionality of the One Island Services may change over time. We may introduce new Services, improve existing features, suspend features temporarily or permanently withdraw Services where reasonably necessary. We may also change how particular Services operate in order to improve the platform, comply with legal or regulatory requirements, maintain security or respond to operational needs.

We will make reasonable efforts to keep the One Island Services available and up to date. However, not every Service will be available to every user, device or location, and certain features may depend on third-party systems or information that are outside our control.

7. Availability of Services

We aim to make the One Island Services available whenever possible and to provide a reliable, high-quality experience for all users. However, we do not guarantee that the Services, or any individual feature, will always be available, uninterrupted, secure or error-free.

From time to time, we may carry out planned maintenance, introduce updates, implement security improvements or make changes to the One Island Services. Where reasonably practicable, we will endeavour to provide advance notice of planned maintenance or significant service interruptions.

The availability of certain Services may also depend on third-party systems, information or infrastructure that are outside our reasonable control. This includes, for example, transport information, mapping services, government data, taxi availability, telecommunications services and other integrated platforms. Temporary interruptions, delays or inaccuracies may occur where these third-party services are unavailable or experiencing technical issues.

We may modify, suspend or withdraw any part of the One Island Services at any time where reasonably necessary, including to improve the platform, introduce new functionality, comply with legal or regulatory requirements, address security concerns or respond to operational needs.

Where possible, we will seek to minimise disruption and restore affected Services as quickly as reasonably practicable.

8. Community Standards

One Island is designed to be a trusted platform that connects people, businesses, organisations and communities across the Isle of Man. We ask all users to help us maintain a safe, respectful and welcoming environment for everyone.

When using the One Island Services, you are expected to:

  • treat other users, businesses, organisations and our team with courtesy and respect;
  • communicate honestly and responsibly;
  • provide accurate information where you submit content or interact with others;
  • respect the rights, privacy and safety of other users; and
  • use the Services in a way that supports a positive and inclusive community.

You must not use the One Island Services to:

  • harass, intimidate, threaten or abuse another person;
  • publish or share content that is unlawful, defamatory, discriminatory, hateful, offensive or otherwise inappropriate;
  • impersonate another individual, business or organisation;
  • encourage illegal or harmful activity; or
  • disrupt the safe and respectful use of the Services by others.

We reserve the right to investigate behaviour that we reasonably believe breaches these Community Standards and to take appropriate action, including removing content, restricting access to certain Services or suspending accounts in accordance with these Terms.

9. Acceptable Use

You must use the One Island Services lawfully, responsibly and in accordance with these Terms.

You must not:

  • use the One Island Services for any unlawful, fraudulent or unauthorised purpose;
  • provide false, misleading or deceptive information;
  • impersonate another individual, business, organisation or public authority;
  • create fake accounts, business listings, event listings or other content;
  • make fraudulent, abusive or unnecessary taxi bookings or other service requests;
  • misuse promotions, referral programmes, discounts, rewards or other incentives;
  • attempt to gain unauthorised access to the One Island Services, user accounts or connected systems;
  • interfere with, disrupt or attempt to compromise the security, availability or integrity of the One Island Services;
  • upload, transmit or distribute viruses, malware, ransomware or any other malicious code;
  • scrape, crawl, harvest or otherwise extract data from the One Island Services using automated or manual methods without our prior written permission;
  • reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or underlying technology of the One Island Services, except where permitted by applicable law;
  • use automated scripts, bots or other technologies to manipulate, overload or interfere with the operation of the Services;
  • use the One Island Services in a way that infringes the rights of another person or organisation, including intellectual property rights or privacy rights; or
  • use the One Island Services in any manner that may damage the reputation, security or operation of One Island or adversely affect other users.

Where we reasonably believe that these Terms have been breached, we may investigate the matter and take appropriate action, including restricting access to certain features, removing content, suspending or terminating accounts, reporting unlawful activity to the relevant authorities or taking any other action reasonably necessary to protect the One Island Services, our users and our partners.

10. User Content

Certain One Island Services may allow you to submit, upload or publish content, including reviews, comments, photographs, business information, event listings, promotional material, feedback and other content ("User Content").

You remain the owner of any User Content that you create or submit.

By submitting User Content through the One Island Services, you grant One Island a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, store, display, publish, distribute, adapt, modify (for formatting or technical purposes), promote and otherwise process that User Content for the purpose of operating, improving, protecting and promoting the One Island Services.

You confirm that:

  • you own the User Content or have the necessary rights and permissions to submit it;
  • your User Content is accurate to the best of your knowledge where it states facts;
  • your User Content does not infringe the intellectual property, privacy or other legal rights of any person or organisation; and
  • your User Content complies with these Terms and all applicable laws.

You must not submit User Content that is unlawful, defamatory, misleading, fraudulent, discriminatory, abusive, obscene, offensive or otherwise inappropriate, or that contains malware, unsolicited advertising or other harmful material.

One Island does not routinely review all User Content before it is published. However, we reserve the right to review, moderate, edit, refuse, suspend or remove any User Content where we reasonably believe it breaches these Terms, applicable law or the safe and effective operation of the One Island Services.

Where reasonably practicable, we may contact you before removing or significantly editing your User Content. However, we reserve the right to take immediate action where this is necessary to protect users, comply with legal obligations, safeguard the integrity of the platform or prevent harm.

If you delete your User Content or close your account, copies of that content may remain where this is reasonably necessary for legal, regulatory, security, backup or operational purposes, or where the content forms part of the normal operation of the One Island Services.

11. Business Listings

One Island may allow businesses, organisations, charities, community groups and other entities to create, claim, manage or promote listings through the One Island Services.

Businesses are responsible for ensuring that all information they provide is accurate, complete, up to date and does not mislead users. This includes, where applicable, business names, descriptions, contact details, opening hours, locations, services, promotions, images and any other information published through the platform.

Businesses retain ownership of the content they submit. By submitting or publishing business information through the One Island Services, businesses grant One Island the licence described in Section 10 (User Content) for the purpose of operating, displaying, promoting and improving the platform.

One Island does not routinely verify the accuracy, completeness or quality of information submitted by businesses and does not guarantee that business listings will always be current or error-free. Users should contact the relevant business directly if they need to confirm important information before relying upon it.

We reserve the right to review, edit, suspend, remove or refuse any business listing where we reasonably believe that:

  • the information is inaccurate, misleading or no longer current;
  • the listing breaches these Terms or applicable law;
  • the listing infringes the rights of another person or organisation;
  • the listing creates a security, legal or operational risk; or
  • removal is otherwise necessary to protect the integrity, reputation or safe operation of the One Island Services.

Where reasonably practicable, we will seek to contact the business before removing or significantly changing a listing. However, we reserve the right to take immediate action where this is necessary to comply with legal obligations, prevent harm or protect the One Island Services and their users.

12. Events

One Island may allow event organisers, businesses, charities, community groups and other organisations to publish, promote and manage events through the One Island Services.

Event organisers are responsible for ensuring that all event information is accurate, complete and kept up to date. This includes, where applicable, event descriptions, dates, times, venues, accessibility information, ticketing details, pricing, organiser information and any other content relating to the event.

Event organisers retain ownership of the content they submit. By publishing event information through the One Island Services, organisers grant One Island the licence described in Section 10 (User Content) for the purpose of operating, displaying, promoting and improving the platform.

Events may be changed, postponed, cancelled or withdrawn without notice by the organiser or for reasons outside One Island's control. While we encourage organisers to keep event information up to date, One Island cannot guarantee that all event information will always be accurate, complete or current.

Where bookings, registrations, ticket purchases or other event-related services are offered through or linked from the One Island Services, the relevant organiser or third-party provider remains responsible for the event itself, including its availability, delivery, fulfilment, ticketing arrangements, refunds and cancellations, unless we expressly state otherwise.

Users should contact the relevant organiser directly if they need to confirm important event information before making travel arrangements, purchasing tickets or attending an event.

We reserve the right to review, edit, suspend, remove or refuse any event listing where we reasonably believe that:

  • the information is inaccurate, misleading or no longer current;
  • the listing breaches these Terms or applicable law;
  • the listing infringes the rights of another person or organisation;
  • the listing creates a security, legal or operational risk; or
  • removal is otherwise necessary to protect the integrity, reputation or safe operation of the One Island Services.

Where reasonably practicable, we will seek to contact the organiser before removing or significantly changing an event listing. However, we reserve the right to take immediate action where this is necessary to comply with legal obligations, prevent harm or protect the One Island Services and their users.

13. Transport Services

One Island provides a range of transport-related Services designed to help users plan journeys and access travel information across the Isle of Man.

Depending on the Services available at the time, this may include:

  • bus information and journey planning;
  • ferry information;
  • flight information;
  • traffic information;
  • weather information relevant to travel;
  • parking information;
  • timetables;
  • live service updates;
  • route planning and journey estimates; and
  • other transport-related features.

Transport information made available through the One Island Services may be obtained from third-party organisations, public data sources, transport operators, government departments and other information providers. Unless we expressly state otherwise, One Island does not operate transport services or generate the underlying transport data displayed through the platform.

While we make reasonable efforts to present information accurately and as promptly as possible, transport information may change without notice. Timetables, routes, service availability, weather conditions, traffic conditions, parking availability, live updates, delays, cancellations, diversions and journey estimates may be incomplete, delayed, inaccurate or unavailable due to circumstances outside our reasonable control.

Journey planning and estimated travel times are provided for general guidance only. Actual travel times may vary due to traffic conditions, weather, operational changes, service disruptions or other factors.

If your journey is time-sensitive or otherwise important, you should verify the relevant travel information directly with the appropriate transport operator or service provider before travelling. You should not rely solely on the One Island Services when making important travel decisions.

Where the One Island Services include links to third-party transport providers or related services, your use of those services may be subject to the provider's own terms, conditions and privacy policies.

14. Taxi Services

One Island may provide functionality that enables users to request, book and manage taxi journeys through the One Island Services. Unless we expressly state otherwise, One Island provides the technology platform that facilitates bookings between passengers and independent licensed taxi operators or drivers. One Island is not the transport provider and does not itself provide taxi services.

Passenger Responsibilities

When requesting a taxi through the One Island Services, you are responsible for:

  • providing accurate pick-up and destination information;
  • ensuring that any contact details provided are accurate;
  • being ready at the agreed pick-up location and time;
  • treating drivers and vehicles with courtesy and respect; and
  • complying with any reasonable requirements of the taxi operator or driver during your journey.

Driver and Taxi Operator Responsibilities

Taxi operators and drivers are responsible for providing the transportation service, including accepting or declining bookings, arriving at the agreed location, completing journeys safely and lawfully, complying with all applicable licensing and regulatory requirements, and providing any services they agree to deliver.

Taxi operators and drivers remain solely responsible for the transportation services they provide.

Booking Availability

Submitting a booking request does not guarantee that a taxi will be available.

Booking requests are subject to driver and operator availability, service coverage, operational conditions and other factors outside One Island's reasonable control.

Estimated arrival times are provided for convenience only and should not be regarded as guaranteed arrival times.

Cancellations

Passengers and taxi operators may cancel bookings in accordance with the cancellation rules applicable to the Service at the time of booking.

Repeated cancellations, fraudulent bookings or misuse of the booking system may result in restrictions being placed on your account or access to taxi-related Services.

Payments

Where payment functionality is available through the One Island Services, payments may be processed by authorised third-party payment providers or, where applicable, collected directly by the relevant taxi operator or Driver.

At the time these Terms were last updated, transportation fares for Taxi Services are paid directly to the Driver. If One Island introduces integrated payment functionality in the future, the applicable payment arrangements and any additional terms will be made available before those services become available.

Any fares, booking fees, cancellation charges or other applicable charges will be presented before you confirm your booking where reasonably practicable.

Where payment is made directly to the taxi operator or driver, the operator or driver remains responsible for processing the payment and providing any applicable receipt.

Complaints

If you experience an issue with your booking or journey, you should contact the relevant taxi operator in the first instance where appropriate.

One Island may assist in facilitating communication or investigating issues relating to bookings made through the platform but is not responsible for resolving disputes relating to the transportation service itself unless we expressly state otherwise.

Independent Taxi Operators

Taxi operators and drivers using the One Island Services operate as independent businesses and are not employees, agents or representatives of One Island. One Island does not supervise, direct or control how taxi operators or drivers provide transportation services and does not guarantee the quality, suitability or availability of those services. Where taxi operators or drivers maintain their own terms, conditions or privacy policies, your use of their services may also be subject to those terms.

15. Third-Party Services

The One Island Services may include or integrate with information, products and services provided by independent third parties. These may include, but are not limited to:

  • mapping and location services;
  • government information and public notices;
  • transport operators and transport information providers;
  • taxi operators and drivers;
  • businesses and organisations;
  • event organisers;
  • payment service providers; and
  • other third-party products, services or digital platforms.

These third-party services are provided independently of One Island and may be subject to their own terms and conditions and privacy policies. Unless we expressly state otherwise, One Island provides the technology platform that enables users to discover, access and interact with these third-party services. We do not own, operate or control those services and are not responsible for their availability, performance, content, accuracy or the services they provide. Your interactions with third-party providers are primarily between you and the relevant provider. We encourage you to review any applicable terms, conditions and privacy policies before using their services.

16. Payments

Certain One Island Services may require payment, either now or in the future.

Where payment functionality is available, payments may be processed by authorised third-party payment providers acting on behalf of One Island or, where applicable, directly by the relevant service provider.

Where reasonably practicable, any applicable prices, booking fees, service charges, cancellation fees or other charges will be displayed before you confirm a transaction.

Unless otherwise stated, all prices are shown inclusive of any taxes that are required to be included under applicable law. Where additional taxes or charges apply, these will be identified where reasonably practicable.

Refunds, credits or cancellations will be managed in accordance with the terms applicable to the relevant Service, the relevant provider or any published cancellation policy.

One Island reserves the right to introduce, modify or withdraw paid features, subscription services, promotional offers or pricing structures at any time. Any such changes will not affect transactions that have already been confirmed unless required by law or agreed with you.

17. Intellectual Property

Unless otherwise stated, all intellectual property rights in the One Island Services, including the software, platform, branding, trade marks, logos, designs, graphics, text, layout, functionality and other content created or owned by One Island, are owned by or licensed to One Island and are protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

You may access and use the One Island Services for your personal or internal business use in accordance with these Terms. You must not copy, reproduce, modify, distribute, publish, licence, sell, reverse engineer or otherwise exploit any part of the One Island Services except where permitted by applicable law or with our prior written permission.

You retain ownership of any User Content that you submit through the One Island Services. By submitting User Content, you grant One Island the licence described in Section 10 (User Content) for the purpose of operating, maintaining, improving and promoting the One Island Services.

Any feedback, suggestions or ideas you voluntarily provide regarding the One Island Services may be used by One Island without restriction or obligation to compensate you, although you retain ownership of your own intellectual property contained within that feedback.

18. Privacy

Your privacy is important to us.

Our collection, use, storage and protection of personal information is governed by our Privacy Policy, which forms an important part of your use of the One Island Services.

Our use of cookies, software development kits (SDKs) and similar technologies is explained in our Cookie & Similar Technologies Policy.

By using the One Island Services, you acknowledge that your personal information will be handled in accordance with our Privacy Policy and Cookie & Similar Technologies Policy.

19. Disclaimers

One Island provides a technology platform that aggregates information and facilitates access to a wide range of services from multiple sources.

While we make reasonable efforts to ensure that information made available through the One Island Services is accurate, timely and reliable, we do not guarantee that any information or Service will always be complete, accurate, current, uninterrupted or error-free.

This includes, but is not limited to:

  • transport information;
  • bus, ferry and flight information;
  • journey planning and estimated travel times;
  • weather information;
  • traffic information;
  • parking information;
  • public notices;
  • business listings;
  • event information;
  • promotions;
  • maps and location information;
  • live service updates; and
  • other information provided by or obtained from third parties.

Many Services rely upon information supplied by transport operators, government organisations, businesses, event organisers, taxi operators and other independent third parties. One Island does not control the accuracy, availability or performance of those third-party services or information.

Unless expressly stated otherwise, information provided through the One Island Services is supplied for general information and convenience only. Users should verify important information directly with the relevant organisation or service provider before relying upon it to make travel, purchasing, business or other significant decisions.

Nothing in these Terms excludes any rights that cannot lawfully be excluded under applicable law.

20. Limitation of Liability

To the fullest extent permitted by applicable law, One Island, its directors, officers, employees, contractors and affiliates shall not be liable for any indirect, incidental, special, consequential or exemplary loss or damage arising out of or in connection with your use of, or inability to use, the One Island Services.

This includes, without limitation, loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, loss of anticipated savings, loss of data or any other indirect or consequential loss, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any statutory rights that cannot lawfully be excluded or restricted.

You acknowledge that many of the Services made available through One Island are provided by independent third parties. Where a claim relates to the products, services or conduct of a third-party provider, that provider remains responsible for its own acts and omissions to the extent permitted by law.

21. Suspension and Termination

We may suspend, restrict or terminate your access to all or part of the One Island Services where we reasonably believe that:

  • you have breached these Terms;
  • you have used the Services unlawfully or fraudulently;
  • your use poses a security, operational or legal risk to One Island or other users;
  • we are required to do so by law or a regulatory authority; or
  • suspension or termination is otherwise necessary to protect the integrity, security or operation of the One Island Services.

Where reasonably practicable, we will notify you before suspending or terminating your account and explain the reasons for our decision. However, we may take immediate action without prior notice where this is reasonably necessary to protect users, comply with legal obligations or prevent fraud, abuse or other harmful activity.

You may stop using the One Island Services at any time and may close your account using the functionality provided within the platform or by contacting us.

Termination or suspension of your account will not affect any rights, obligations or liabilities that arose before the suspension or termination took effect.

22. Changes to these Terms

We may update these Terms of Use from time to time to reflect changes to the One Island Services, applicable laws, regulatory requirements, technology, security practices or the way in which the platform operates.

Where we make material changes to these Terms, we will take reasonable steps to notify users before those changes take effect. Notification may be provided through the One Island website, mobile application, email, push notification or another appropriate communication channel.

The most recent version of these Terms will always be available through the One Island Services and will include the date on which they were last updated.

By continuing to access or use the One Island Services after updated Terms take effect, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the One Island Services and, where applicable, may close your account in accordance with these Terms.

Where changes are required immediately to comply with applicable law, regulatory requirements, security obligations or to address an urgent operational issue, those changes may take effect without prior notice. In such circumstances, we will notify users as soon as reasonably practicable where appropriate.

23. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or in connection with them, their subject matter or your use of the One Island Services shall be governed by and construed in accordance with the laws of the Isle of Man.

You and One Island agree that, unless otherwise required by applicable law, the courts of the Isle of Man shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the One Island Services.

Nothing in these Terms affects any statutory rights or legal protections that cannot lawfully be excluded under applicable law.
